Under the terms of the trust, Alex will receive a third of the trust's annual income, or about US$1m based on its current value, along with an additional US$35m from a separate custodial account, when he turns 25.
On top of wanting the board of trustees removed, Mrs Hughes is also asking for US$877,000 a year in pocket money for Alex to maintain his lavish lifestyle, which includes extravagant vacations at luxury beach homes and yachts.
The trustees include Alex's paternal grandfather, Mr Jack Reynolds; former Herbalife chief executive Christopher Pair, who was a longtime friend of Mr Hughes; and Mr Conrad Lee Klein, a lawyer who was Mr Hughes' personal counsel for almost 20 years.
On top of saving over US$100m in estate taxes, the board also sold Mr Hughes' company for twice its market value when he died, and successfully opposed nearly US$500m in claims.
In fact, a lawyer working for the trust said that most of the money spent by the trust since Mr Hughes' death has gone to defending lawsuits launched against them by Mrs Hughes.
Mr Kenneth Ziskin, a lawyer representing the trust, told the LA Times that the trustees were so concerned about what an extravagant lifestyle might do to Alex at his age that they consulted a psychiatrist, who has had many dealings with wealthy children, and also a rabbi who wrote a book on people of great wealth.
'They both warned the trustees that providing enough money so that Alex would live an extravagant and lavish lifestyle would probably not be good for him,' Mr Ziskin said.
While the trustees are not opposed to to giving Alex some spending money, lawyer Mr Edward Woods, who also represents the trust, said that the trustees would like speak to Alex directly to find out what he wants.
The trust's lawyers believe that Alex's mother is fighting them tooth and nail because her attempt with other bidders to take over Herbalife after her ex-husband's death was rejected by the trustees.
They also think that she may be unhappy with her divorce settlement, where she got US$10,000 a month in child support for Alex, while the trust pays a further $100,000 for her property taxes and her son's tuition.
She has also filed a sexual harassment lawsuit against trustee Mr Pair for allegedly agreeing to release money for the Malibu home in exchange for sex.
She went on to become an actress who had bit parts in the 1996 comedy Kingpin (with Woody Harrelson) and the TV soap opera The Bold and The Beautiful.
The show is said to feature herself and three other Beverly Hills women using their wealth and Hollywood clout to help down-and-out families overcome their problems.
Based on interviews with those close to him, the paper revealed that he had actually grown up in a middle-class family enjoying 'the best toys, the best stuff, the best clothes'.
